Participant Release, Waiver of Liability and Indemnity Agreement

In consideration of being allowed to attend and participate in the Krav Maga program(s) listed above, and any of their related events and activities, the undersigned, hereby freely and voluntarily, with full understanding of the terms and meaning of this agreement, signs this agreement for the benefit of 911 Self Defense, Inc., a Texas corporation, dba Krav Maga Worldwide, T.A.S.K., STW Self Defense – Fitness - Fit to Fight, and Hardy Fitness System, and Dangerously Cute Women’s Self Defense, LLC., a Texas limited liability company, and each of their respective officers, directors, shareholders, members, managers, owners, employees, contractors, agents, attorneys and representatives (collectively, "Krav Maga").

l. Acknowledgement of Risk. I understand and acknowledge that attendance at the program involves inherent risks and dangers and that participation in the activities involved in the program expose me to risk of property damage and/or serious personal bodily injury, including permanent paralysis, disability and death, and while my particular skills, equipment, and personal discipline may reduce this risk, the risk of property damage and serious personal bodily injury remains.

2. Assumption of Risk. I HAVE CONSIDERED THE NATUR E AND EXTENT OF THE RISKS INVOLVED, AND I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS RELATED TO OR ARISING OUT OF MY ATTENDANCE AT OR PARTICIPATION IN THE PROGRAM, BOTH KNOWN AND UNKNOWN, EVEN THOSE RISKS ARISING FROM THE NEGLIGENCE OR MISCONDUCT OF THE RELEASEES (DEFINED BELOW) OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR MY ATTENDANCE AT AND PARTICIPATION IN THE PROGRAM.

3. Compliance with Program Rules. I willingly agree to comply with Krav Maga's rules for participation in the program, as well as any other party's stated and/or customary terms and conditions for participation in any related event or activity. In addition, if I observe any unusual activity or significant hazard during my attendance at or participation in the program, I agree to promptly remove myself from participation and bring such matter to the attention of Krav Maga immediately. Krav Maga reserves the right to deny admittance or to remove from its facilities, any participant who fails to obey the rules and regulations of Krav Maga and/or whose access to or use of Krav Maga's facilities creates a danger of health or safety to you or other participants, guests or employees.

4. Release and Indemnity. I, FOR MYSELF AND ON BEHALF OF MY HEIRS , PERSONAL REPRESENTATIVES, ESTATE, SUCCESSORS AND ASSIGNS, HEREBY FULLY, FINALLY AND UNCONDITIONALLY RELEASE, REMISE AND DISCHARGE KRAV MAGA , KRAV MAGA TRAINING OFFICIAL CENTER SAN ANTONIO, KRAV MAGA WORLDWIDE ENTERPRISES, KRAV MAGA ASSOCIATION OF AMERICA, KRAV MAGA PRODUCTIONS, KRAV MAGA ALLIANCE LLC, STRIKEFIT LLC, ALLIANCE CULVER CITY LLC, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, MANAGERS, OWNERS, EMPLOYEES, CONTRACTORS, OFFICIALS, AGENTS, ATTORNEYS, ADVISORS, REPRESENTATIVES, OTHER PARTICIPANTS, SPONSORING AGENCIES, SPONSORS, ADVERTISERS, AND IF APPLICABLE, OWNERS AND LESSORS OF THE PREMISES USED FOR THE ACTIVITY (COLLECTIVELY "RELEASEES"), AND SHALL INDEMNIFY, DEFEND AND HOLD EACH OF THE RELEASEES HARMLESS, FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, ACTIONS, CAUSES OF ACTIONS, DEMANDS, DAMAGES AND INJURIES, WHETHER PERSONAL OR TO PROPERTY, THAT MAY OCCUR IN CONNECTION WITH, ARISE OUT OF OR IN ANY WAY RESULT FROM MY ATTENDANCE AT OR PARTICIPATION IN THE PROGRAM (COLLECTIVELY "CLAIMS"), WHETHER KNOWN OR UNKNOWN, FIXED OR CONTINGENT, INCLUDING CLAIMS ARISING OUT OF OR FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW.

5. Covenant Not to Sue. I covenant and agree not to, now or at any time in the future, directly or indirectly, commence or prosecute any action, suit or other proceeding against Releases concerning, arising out of or related to this agreement, including the Claims released in this Agreement.

6. Insurance. In the event of property damage, bodily injury or death, I agree to look solely to my own means or insurance for reimbursement for medical expenses and other damages which I may suffer.

7. Binding Effect: Survival. This agreement shall be binding upon and inure to the benefit of each party and each party's heirs, personal representatives, estate, successors and assigns. The representations, warranties and covenants contained in this agreement shall survive the date hereof.

8. Invalidly. In the event that one or more of the provisions contained in this agreement shall for any reason be held invalid, illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any of the other provisions hereof and this agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.

9. Presence of Law Enforcement Personnel. Krav Maga teaches trains and/or otherwise instructs personnel from various law enforcement agencies, military units and/or other governmental agencies, albeit in the individual's unofficial capacities. In order to preserve the validity and integrity of the Krav Maga concept and to maintain quality control and uniformity of the same, and to ensure that Krav Maga does not teach, train and/or otherwise instruct individuals who would use the Krav Maga concept in connection with any illegal, unlawful or immoral activities, Krav Maga has requested that the various law enforcement personnel taking its classes report any participant to Krav Maga who they believe to be taking classes to use of the Krav Maga concept in connection with any illegal, unlawful or immoral activities.
I HAVE READ THIS PARTICIPANT RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT AND FULLY UNDERSTAND ITS TERMS AND AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE TO ME. I UNDERSTAND' THE AGREEMENT IS A RELEASE OF ANY AND ALL CLAIMS. I UNDERSTAND THAT AS A PARTICIPANT, I ASSUME ALL RISKS INHERENT IN MY ATTENDANCE AT AND/OR PARTICIPATION IN THE PROGRAM. I FULLY UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING BELOW, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR RESERVATION.
